Who Can Apply for the EEA Permanent Residence?

The EEA Permanent Residence is like indefinite leave to remain. Once you are granted this visa, then you can continue living in the UK regardless of time. Many immigrants of UK want to apply for this permanent residence visa to continue living in the UK with no immigration restrictions. If you want to apply for the permanent residence status, then you must have lived in the UK for continuous 5 years. However, there are some limitations on the amount of time one can be absent from the UK to eligible for a permanent resident.

If you are absent for 6 months or less, or in some cases 12 months or less, then it will not interfere with the residency. However, if you are absent for a prolonged period of time, you need to detail your reasons for absence and submit the evidence in your application form. The visa servicing company will do all the things on your behalf and help you get the visa as soon as possible.

Eligibility Criteria for Permanent Residence

  • Your EEA family member has been a qualified person throughout the 5 years or has a permanent right of residence
  • You have lived with your EEA family member in the UK for a continuous 5 years

You can also apply for the permanent residence if you have lived in the UK for successive 5 years:

  • As the family member of a British Citizen, if you entered the UK under the EU law after living in another EEA country
  • As the extended family member of an EEA national and you have held a valid EEA family permit and a residence card throughout
  • First as the family member of an EEA nation and then with a retained right of residence

You can also apply for the permanent residence before 5 years if either:

  • Your EEA national family member was working or self-employed in the UK but has ‘ceased activity’
  • You were living with your EEA national family member, who was working or self-employed in the UK, immediately before their death

How to Apply for the Permanent Residence

The qualified persons can apply for the permanent residence either online or by visiting the physical visa office. Once you have downloaded and filled the visa application form, you need to post it to the office.
